Edgecomb woman sues over Wiscasset restaurant’s lease
Judith Casella of Edgecomb claims in court documents that she was left holding the bag on a Brunswick couple’s lease and bills for a Wiscasset restaurant.
Lincoln County Superior Court received Casella’s civil suit Feb. 17. The defendants are Brian Tebben and Amanda Bernier of Brunswick.
The suit claims Casella leased Tebben and Bernier the Lighthouse Lobster Shack and BBQ at 506 Old Bath Road, next door to another business Casella runs at the same address, Judy’s Country Store.
Along with the complaint, Casella filed a document purportedly signed by her, Tebben and Bernier on May 2, 2015. Headed “Lease proposal,” it lists a six-month term at $1,000 a month and states that utilities are the tenant’s responsibility.
Casella claims she asked the couple monthly to put the utilities in their name and to pay them, but that they did not.
“I did not want the restaurant to shut down because that would affect my store and the business,” Casella states in a Jan. 29 affidavit.
In the complaint and other documents on file with the suit, Casella claims that Tebben and Bernier left the leased property early; did not pay $2,500 in rent and $4,892 in electric and water bills; and left a propane tank unfilled. It was full, with $1,000 in propane when they began their tenancy, the complaint states.
The suit asks the court to enforce the lease and award Casella an unspecified sum including interest and legal fees. In court documents, Casella states that she is owed $8,529 in connection with the lease.
The court on Feb. 23 rejected Casella’s attempt to attach the defendants’ assets without first notifying Tebben and Bernier. A Superior Court justice ruled Casella had not sufficiently shown a clear danger that the defendants would try to hide their assets or move them out of state.
The ruling states that, after Tebben and Bernier have been notified, Casella can try again to have the assets attached.
Casella and her lawyer, Portland attorney Gerald Schofield Jr. declined comment on the suit Monday. Attempts to reach Tebben and Bernier were not immediately successful.
