Huber’s fire leads to proposed fine
Wiscasset Town Manager John O’Connell has received a proposed consent agreement for a training burn that occurred at Huber’s Market Aug. 4 without permission of the Department of Environmental Protection, according to the proposal that would fine the town $1,000. Selectmen take up the proposed deal Tuesday night, Dec. 17, according to an agenda released Dec. 12.
The proposed deal was included in the supporting documents for the meeting.
The proposed consent agreement stipulates the fire did not meet DEP requirements on removing certain waste products, including fluorescent lights and aerosol cans from the structure before the fire, and that then-fire chief TJ Merry also failed to present a written training plan to the DEP prior to the burn. The town received smoke complaints, according to the proposed agreement. In September, the town was informed the incident was a violation of air quality regulations. Also, O’Connell said he removed Merry as chief after consulting DEP, Maine Fire Service Institute, Maine Municipal Association and the State Fire Marshal’s Office.
DEP sent the consent agreement to O’Connell at the end of November. It stipulated the town agree to and return the signed form with a check for the fine within five working days of receipt, but the select board did not meet Dec. 3 due to a snowstorm.
