Restitution amount amended for Franklin Poe
A motion to amend former Boothbay attorney Franklin Poe’s restitution order was granted on January 18.
Because Poe is on disability, living on $700 per month, the Department of Corrections requested $25 be paid per month until the full restitution amount of $55,632 has been received. The motion, signed by Judge Dan Billings, was filed by Patrick T. Delahanty for the Division of County Corrections.
Poe was found guilty of theft in 2010 while acting as sole trustee of the Josephine Day Revocable Trust.
Poe was not present at the January 18 hearing. According to Assistant Attorney General Leanne Robbin, he was not required to. Poe is currently residing in Michigan.
On May 4, 2011, a Justice Andrew Horton ordered restitution in the amount of $55,632. While incarcerated, $25 payments were to begin based on Poe's ability to pay. In January 2012 his monthly installments were to rise to $250 and increase to $500 per month two years later.
Josephine Day started the Trailing Yew Inn on Monhegan Island in 1926. Poe became Day's attorney in 1995 and created the trust before her death in 1996.
In February 2009 Poe was disbarred, in addition to serving 15 months in prison, 1-year probation and restitution.
