Boothbay Harbor man charged with prison trafficking
A Boothbay Harbor man has been arrested and charged with felony trafficking after he allegedly brought drugs into Two Bridges Regional Jail.
Dale Havens, 36, of Boothbay Harbor was arrested and charged with trafficking in prison contraband and misdemeanor violating the conditions of his release.
Havens was arrested while he was incarcerated at the jail in Wiscasset on Nov. 5.
According to the arrest report, Havens came to the attention of Lincoln County Sheriff’s Deputy Paul Rubashkin from video and phone recordings at the jail.
Those recordings led Rubashkin to believe that Havens had obtained drugs at the West Bath court house and brought them back to Two Bridges.
Rubashkin performed a dormitory sweep with several other officers. According to his report, Rubashkin and the officers entered the housing unit, at which point Rubashkin claimed Havens began walking away from them.
Havens was ordered to put his hands on the wall and wait for further instructions while the officers searched his cell.
According to the report, Rubashkin and the other officers allegedly found a creamer package containing a Vicodin pill, a “quarter strip” of suboxone, a “usable amount” of marijuana and the striker part of a matchbook. Afterward all units were checked and when a further sweep was performed in Havens' room, officers allegedly found more marijuana hidden in toilet paper attached to a vent. Officers also allegedly found rolling papers during the sweep.
Rubashkin made a note of Havens allegedly living alone during the time of the sweep. Havens allegedly refused to be drug-tested and declined to speak with officers. Because Havens was on bail conditions to submit to searches, he allegedly violated those conditions when he refused the drug test.
When Rubashkin reviewed video from the sweep, he reportedly saw Havens allegedly dropping the creamer package where it was found.
Havens was arrested and charged with Class C trafficking in prison contraband and Class E violating the conditions of his release.
Havens has been arrested several times and is currently facing felony charges in Sagadahoc County.
Havens was indicted in July 2015 by a Cumberland County Grand Jury for allegedly leading police on a car chase through Yarmouth in May 2015. Havens was arrested in Sagadahoc County in June and charged with Class A aggravated unlawful trafficking in scheduled drugs and Class B conspiracy to commit aggravated trafficking.
Class A, B and C crimes are all felonies, with Class A crimes punishable by up to 30 years in prison and up to a $50,000 fine; Class B crimes carry a maximum sentence of 10 years in prison and up to a $20,000 fine and Class C crimes are punishable by up to five years in prison and up to $5,000 in fines.
Class E crimes are misdemeanors and are punishable by up to six months in jail and up to $1,000 in fines.
