Dresden man claims Bangor dog bit him
A new suit in Lincoln County Superior Court attempts to blame a Bangor father and son for a Dresden man’s dog bites.
Josiah Wyman accuses David Carr Jr. and David Carr Sr. of exposing him to a potentially dangerous animal, a 110-pound rottweiler Carr Jr. was trying to sell him. Wyman’s suit, filed Dec. 21, seeks an unspecified sum for medical care, lost pay and other damages.
Wyman claims he drove to Bangor on Sept. 27 with his 5-year-old daughter, to look at the dog as a possible household pet for her. Carr Jr. had advertised the dog online, according to the suit.
“(He) assured me that the dog’s temperament was not aggressive or dangerous,” the suit states. The Carrs let the dog out unleashed from their 289 Stillwater Avenue, Bangor apartment, Wyman’s complaint continues. “The dog immediately attacked me, biting my groin, my upper right leg and thigh, and my left arm.”
Wyman is claiming liability and negligence on the Carrs’ part, saying they knew or should have known the dog was potentially dangerous. The suit accuses Carr Jr. of misrepresenting the dog in an effort to get Wyman to take it home.
The court file did not include any response yet from the defendants in the suit.
David Clarence Carr, 23, of 289 Stillwater Avenue, Bangor, was summonsed on a charge of keeping a dangerous dog, in connection with a Sept. 27 incident, Bangor Police Sgt. and Public Affairs Officer Tim Cotton said Tuesday. The case remained pending in Bangor District Court, he said.
The department does not release victims’ names, Cotton said.
Wyman’s lawyer, Brunswick attorney Maurice Libner, did not immediately return a message Monday seeking comment on the suit. Attempts Monday and Tuesday to reach the Carrs and Wyman were not immediately successful.
