Man in jail after alleged phone harassment
A Windsor man is in jail after he allegedly violated his probation and contacted a Whitefield woman who has a court order against him.
Dwayne Bates, 26, is in Two Bridges Regional Jail after allegedly violating his probation by reportedly making repeated phone calls to someone who has a court order against him.
Bates was originally arrested after he allegedly made terrorizing threats to the mother of his children in December 2014. Bates had a court order to refrain from making contact with her other than to talk to his children.
Bates was also accused of violating the conditions of a court order in January 2015 after he allegedly made contact with the victim outside the parameters of their agreement. Because he was on bail conditions at the time, he was also charged with Class E violating the conditions of his release.
According to Lincoln County Sheriff’s Deputy Mark Bridgham, Bates, who had not yet been convicted but was on bail conditions, had allegedly called the complainant 26 times in 30 minutes.
Bates agreed to a plea deal in February 2015 that saw him plead guilty to Class D domestic violence terrorizing, while two misdemeanor counts of Class E harassment and Class D threatening were dismissed.
Bates was sentenced to 280 days in jail with all but seven days suspended. He was also sentenced to two years’ probation and had court orders to attend a mental health evaluation and a batterer's intervention course.
Bates was rearrested in August after he allegedly told probation officer Marshall McCamish he allegedly called the victim an “(expletive) load” of times in July, according to court documents. According to court documents, Bates allegedly called the victim repeatedly under the pretense of trying to talk to his children, but would then speak with the victim.
McCamish moved to have Bates’ probation revoked in August for the alleged infractions.
Bates recently appeared in Lincoln County District Court for a probation violation and will have a December 2015 sentencing. He was being held on $1,000 cash bail for making terrorizing threats on the telephone.
