Two Bridges incident leads to charges
A Westport Island man who was in jail for allegedly violating his probation and conditions of release has allegedly broken those conditions again while in custody.
Matthew Plummer, 32, was rearrested for allegedly destroying property at the jail and violating his bail conditions. Plummer pleaded not guilty to both charges.
On Oct. 19, Plummer is alleged to have smashed a door window inside the jail, which led to the Class D criminal mischief charge. Because part of his release conditions stipulate that he not commit any new crimes, Plummer was also charged with Class E violating conditions of release.
Plummer was held on $750 cash bail and will have a court date on Dec. 14 in Lincoln County Unified Court.
Plummer was in jail for an alleged string of infractions stemming from a prior conviction.
Plummer was convicted on one count of Class C unlawful possession of Oxycodone May 30, 2013 and was sentenced to four years in prison with all suspended and two years’ probation.
As part of his probation, Plummer was ordered to have no new criminal charges, however he allegedly violated those conditions in September.
Plummer was placed under arrest Sept. 8 after allegedly violating his conditions, according to a report filed by Lincoln County Sheriff Detective Jared Mitkus.
According to Mitkus' report, while Plummer was being placed under arrest he allegedly resisted to the point where Mitkus was forced to lower him to the ground to get handcuffs on him.
Mitkus reported that Plummer allegedly had a smell of alcohol on his breath and as part of his conditions of release was forbidden from consuming any intoxicants. When he was later tested via intoxilyzer Plummer allegedly had a blood alcohol content of .06.
Plummer was arrested in 2013 for domestic violence assault, and again in 2014 for allegedly violating the conditions of his release, and in 2015 in Belfast for allegedly being intoxicated.
If convicted Plummer could face up to 364 days in jail for Class D criminal mischief and up six months in jail for the Class E violation of conditions of release charge. Both Class D and Class E crimes are misdemeanors and carry a maximum fine of $2,000 and $1,000, respectively.
