Boothbay Harbor man charged with stalking while on probation
A Boothbay Harbor man, who was already on probation for a stalking conviction, was charged Dec. 3 with another stalking charge.
Nicholas Livingston, 27, of Boothbay Harbor, was charged with a Class D count of stalking after he allegedly refused to stop messaging a Boothbay Harbor woman.
Livingston was convicted of Class D stalking Oct. 30, 2014, and was given 180 days in jail, all suspended, and placed on probation for a year. He had been arrested Oct. 1, 2013, and charged with stalking a Boothbay woman.
Each case involved a different woman.
According to court documents, Livingston is alleged to have contacted the second woman over the Internet during the summer.
The pair allegedly swapped electronic messages, and at one point set up a date, which didn't happen. The two only allegedly met face-to-face once, after Livingston reportedly showed up to rake leaves in the victim’s yard in November.
After the canceled date, court documents allege that Livingston reportedly became obsessive and sent excessive texts.
At different times, the victim is alleged to have expressed her discomfort with the tone and direction of the conversations, including saying that he was reportedly stepping over her boundaries.
According to a police report, she did not tell him to stop contacting her, only to back off.
On Saturday, Nov. 29 the victim spoke with friends who said the behavior was not normal, and the victim soon thereafter spoke with police.
Soon thereafter, Officer Tom Chryplewicz with the Boothbay Harbor Police Department interviewed the victim and warned Livingston that he was being placed on a probation hold, and that his probation officer had been told. Livingston was barred from contacting the victim or showing up at her home or place of employment.
On Nov. 30, the victim called police saying Livingston had reportedly sent her, and everyone she knew within the area, Facebook friend requests.
Livingston was arrested Dec. 3 and charged with Class D stalking.
Livingston was held on $5,000 cash bond at Two Bridges Regional Jail. As part of his release agreement, he is forbidden from contacting the victim or her family. He was ordered to have no social media profiles, nor text messaging capabilities. He is not allowed to be in possession of a phone, computer or other electronic device.
He is scheduled to appear Jan. 8 at Lincoln County District Court.
