Boothbay man arrested for alleged heroin possession
A Boothbay man on bail for charges alleging he stole more than $15,000 in brass from a local boat yard has been rearrested and charged with alleged heroin possession.
Maxwell Alley, 26, was arrested by Lincoln County Sheriff’s Deputy Aaron Beck and Detective Jared Mitkus on April 1 and charged with Class C unlawful possession of scheduled drugs and Class E violating the conditions of his release.
According to the arrest report, Mitkus went to Alley's Boothbay home on April 1 to perform a compliance check, which is reportedly part of Alley's pretrial conditions.
Once inside, Mitkus reportedly found several baggies, which would later test positive for heroin. Mitkus also allegedly found used needles and other drug paraphernalia. Alley was arrested and charged with felony possession, and because his bail conditions included that he not use nor possess drugs, he was charged with misdemeanor violation of conditions.
Alley was originally charged with Class C burglary and Class C possession of scheduled drugs in January after being arrested by the Maine State Police.
Alley allegedly took the metal, which included custom propellers, from an East Boothbay boat yard where Alley was reported to have once worked. Alley then took the more than 500 pounds of metal to an Augusta yard where it was scheduled to be scrapped. The total cost of the stolen brass was reportedly more than $15,000.
The metal was recovered, and the boat yard owner recognized the custom brass propellers. Alley was arrested shortly thereafter and when he was searched, officers allegedly found a small amount of heroin on his person.
Class C charges carry a maximum sentence of five years in prison and up to a $5,000 fine. Class E charges are misdemeanors and are punishable by up to six months in jail and up to a $1,000 fine.
As part of his bail conditions, Alley is not allowed to return to the boat yard, and will be subject to compliance checks. He was held on $1,000 bail, and will have a court date June 8.
