A former Wiscasset woman who made headlines by filing a suit against Moody's Diner in Waldoboro is headed to jail.

Allina Diaz, 28, formerly of Wiscasset, pleaded guilty to felony drug trafficking charges and will serve four months of a four-year sentence after pleading guilty on May 18 in Lincoln County Superior Court.

Diaz was sentenced to four years in prison, with all but four months suspended, and will be on probation for two years. She will also have to pay $515 in fines and seek drug counseling.

Diaz also pleaded guilty to Class C unlawful trafficking and Class E violating the conditions of her release, for which she was sentenced to 30 days in jail, to run concurrent with her other sentence.

From March 2, 2014 to July 31, 2014 Diaz and her boyfriend, Nathan Brewer of Wiscasset, illegally imported black tar heroin from a source in California. Brewer was arrested in 2014 in Wiscasset by the Maine Drug Enforcement Agency after he picked up a package at the Wiscasset Post Office.

According to court documents, Brewer's arrest was a result of a months-long investigation. When he was searched by MDEA special agent Chad Carleton, Brewer was found to be carrying 10.8 grams of black tar heroin.

When a search warrant was executed on Brewer's Wiscasset home, investigators found evidence of drug use and other items typically used in the sale and manufacture of drugs, such as a digital scale, cutting agents, packing materials and hypodermic needles.

Brewer too was charged with Class A aggravated trafficking and Class C illegal importation of drugs. In March of 2015 he pleaded guilty to the Class A charge and the Class C charge and was sentenced to 10 years in prison with all but five years suspended and four years of probation. According to the Maine Department of Correction's website, Brewer is currently incarcerated at the Maine State Prison in Warren with an earliest release date of Feb. 1, 2019.

Diaz’s Class A aggravated trafficking charge was dropped to a Class B unlawful trafficking charge, and her Class C illegal importation charge was dismissed.

According to Penobscot Bay Pilot, Diaz filed a lawsuit against Moody's Diner in Waldoboro alleging the restaurant violated her civil rights.

Diaz's lawsuit, which claims religious persecution at Moody's Diner, had Gov. Paul LePage get involved at one point.
