Man arrested after allegedly strangling, threatening 67-year-old
A man who allegedly strangled a woman who had a protective order against him has been charged with aggravated assault, among other charges.
Luke Dale-Smith, 30, of Jefferson was arrested July 23 after he allegedly threw a woman on the ground and strangled her and allegedly made threats against her and a 98-year-old woman.
Dale-Smith reportedly had a protective order placed against him from the victim.
Lincoln County Sheriff’s Deputy Kenneth Hatch responded to a house in Jefferson after someone reported a domestic disturbance. Once there, Hatch met with a 67-year-old woman who claimed she was thrown to the ground and strangled, allegedly by Dale-Smith. During that altercation, Dale-Smith is also alleged to have threatened to kill the victim and a 98-year-old woman who was related to the victim if they called the police.
According to Hatch's report, the 67-year-old victim was bleeding from the back of her head and was sent to Miles Memorial Hospital in Damariscotta. The victim claimed that Dale-Smith had allegedly been abusing her for weeks, and that he had shoved her numerous times, resulting in bruises.
Dale-Smith allegedly admitted to Hatch that he knew there was a protection order on him and that he was not supposed to be at the residence. When Hatch asked Dale-Smith about the incident, he allegedly said he had an argument with the victim, but stated he didn't recall if he allegedly threw her to the floor and strangled her.
Dale-Smith then allegedly admitted that it could have happened and that the victim wouldn't lie.
Dale-Smith was arrested and sent to Two Bridges Regional Jail in Wiscasset, where he was held on $20,000 bail. Dale-Smith has been Two Bridges one other time — from Nov. 19, 2013 to Jan. 9, 2014 for domestic violence terrorizing.
On Dale-Smith's jail intake sheet, it was reported that he had allegedly had 16 shots of alcohol.
Dale-Smith was charged with Class B aggravated assault, Class C violation of a protective order, Class D domestic violence threatening, Class D criminal threatening.
Class B crimes are felonies punishable by up to 10 years in prison and up to $20,000 fines; Class C crimes are also felonies and are punishable by up to five years in prison and up to $10,000 in fines. Class D crimes are classified as misdemeanors and are punishable by up to 364 days in jail and up to a $2,000 fine. He will have a court date Sept. 28 at the Lincoln County Court House.
